The laws in Thailand does not allow foreigners to own a land, a house or a villa. However, a foreign individual can own a land or a house through formation of Thailand company. The company as a Thailand entity can buy and sell lands and houses. There are many different types of companies that can be set up according to your plans and also the country of your citizenship. If you a United States Citizen, you may qualify to set up a company through US Amity that will allow you to own up to 100% shares in the company.

There are many real estate agents in Thailand and as real estate is not a regulated industry, it is important that you work with a real estate company such as Nazeri & Company and not with individual real estate freelancers. The legitimate companies are all licensed by the ministry of labor and and they also have been registered with the the Thailand Revenue Department.

We always recommend to our clients to rent for at least 3-6 months whether they are considering buying a house in Bangkok, Phuket, Hua Hin or Chang Mai. This give you an opportunity to learn more about the area and the neighborhood that you like to live in before you part with your money.

There are many builders that are selling homes off of a display unit and paper floor plan. It is our advice that it is best if you can see the unit, walk through it before you invest money in buying a house at a new development project in Thailand. If you are considering buying a house in Bangkok from the floor plans, it is best if you can visit other properties by the same developer and talk to the owners of those properties. Finally, when you have found your perfect place in Thailand to call home, you need to be aware of the taxes, the transfer fees that must be paid at the land office.
